In the 2022/23 reporting period, the Basic Law was amended twice. The Federal Constitutional Court has dismissed several complaints against parliamentary decisions concerning European integration. It has issued a number of important rulings on various constitutional questions, including party financing, the parliamentary procedure, the debt restrictions for the national budget and the consequences of defects in the electoral procedure. In the area of fundamental rights, the reported decisions deal with issues of criminal law and criminal procedure, data protection as a limit to the powers of security authorities, social benefits for foreigners and the restriction of the freedom to conduct a business in favour of climate protection.

Au cours de la période de référence 2022-2023, la Loi fondamentale a été modifiée à deux reprises. La Cour constitutionnelle fédérale a rejeté plusieurs plaintes contre des décisions parlementaires concernant l’intégration européenne. Elle a rendu un certain nombre d’arrêts importants sur diverses questions constitutionnelles, notamment le financement des partis, la procédure parlementaire, les restrictions à l’endettement pour le budget national et les conséquences des vices de la procédure électorale. Dans le domaine des droits fondamentaux, les décisions rapportées portent sur des questions de droit pénal et de procédure pénale, sur la protection des données en tant que limite aux pouvoirs des autorités de sécurité, sur les prestations sociales pour les étrangers et sur la restriction de la liberté d’entreprise en faveur de la protection du climat.

Im Berichtszeitraum 2022/23 wurde das Grundgesetz zweimal geändert. Das Bundesverfassungsgericht hat mehrere Klagen gegen europapolitische Entscheidungen abgewiesen. Es hat einige wichtige staatsorganisationsrechtliche Urteile erlassen, u.a. zur Parteienfinanzierung, zum parlamentarischen Verfahren, zur Schuldenbremse und zur Folge von Wahlfehlern. Im Bereich der Grundrechte befassten sich die berichteten Entscheidungen mit Fragen des Straf- und Strafprozessrechts, des Datenschutzes als Grenze der Befugnisse von Sicherheitsbehörden, der Sozialleistungen für Ausländer und der Beschränkung der unternehmerischen Freiheit zugunsten des Klimaschutzes.
